On January 19th I made a deal with “RBT” for an OPY Typo and an OPY Peach in near mint condition and including shipment.
He gave me an e-mail address for PayPal.
I paid.
He refuses to deliver.
I set him February 25th as deadline - via PM in YoYoExpert-forum and in addition directly to his e-mail address - for the two OPYs to arrive at my home.
Still no delivery.
I see no other option for me than to sue my OPYs out of Mr. Robert “RBT” H.
Royal Mail was not delivering internationally so I refunded, I do not see what the issue is.
I have a screenshot of the refund if needed, I apologized for the inconvenience but there was nothing else I could do other than send a refund, Josef has been nothing but aggressive towards me since demanding his yoyos that he was refunded for this has been going on for weeks and weeks.
I wasnt going to say it but Ill just say it lol. Dude he gave you a refund, he doesnt control international mail deliveries. But I am super curious what international court do you think would hold that circus of a “lawsuit”?
I can confirm that Mr. H. refunded.
The issue is that I told clearly that I don’t want refund.
I really do not care what he does with his money - donating it to the salvation army or whatever.
I fulfilled my part of the contract of sale - I paid and submitted everything he wanted to know: My postal address, my e-mail address, my cellphone number.
As soon as I got to know Royal Mail had major problems I wrote that I think we just need to be patient and wait until Royal Mail got them fixed.
He feels ‘harassed’ by me just insisting in the contract.
He refuses to fulfill his part of it.
I got legal protection for being severely disabled and therefore recipient of welfare.
Can someone please explain him what a contract of sale is?
I can tell you really wanted the yo-yos and are disappointed. I’m sympathetic in that regard. But keep in mind that we’re all random people with a common hobby, moving around our collections. Your experience with buyers and sellers will vary and life may occasionally cause a deal to fall through, sometimes in a way that doesn’t meet your expectations.
Good time for the reminder that most of us ignore anyway: “There is always another yo-yo.”

If there was an inability to deliver the goods based on outside influences- that would probably deem any actual contract written null and void
Leaving out that he refunded your money in your initial post in an effort to gain favor is inexcusable. Losing out on yoyos you obviously really want sucks. Sacrificing your integrity sucks worse.
